Crisis, answered plainly

What can I do if a hospital wants to discharge someone with nowhere safe to go?

Your rights, the appeal you can file today, and who to call.

You can act right now. Ask to speak with the hospital case manager and patient advocate, and insist on a safe discharge plan — hospitals are required to do discharge planning. If the patient has Medicare and you think the discharge is too soon, you can appeal by calling your BFCC-QIO (the number is on the “Important Message from Medicare” notice) before you leave. Loop in your local Aging & Disability Resource Center at 800-677-1116.

Ask for a safe discharge plan

Medicare’s hospital rules require discharge planning and that patients be told about their post-hospital options. Ask the case manager / discharge planner to document why the plan is safe, and ask the patient advocate (or patient relations) to help if it isn’t.

Appeal a Medicare discharge you think is too soon

If the patient has Medicare, you can appeal a discharge before leaving. Call the Beneficiary and Family Centered Care Quality Improvement Organization (BFCC-QIO) listed on the “Important Message from Medicare” you received at admission. While the appeal is pending, you generally can’t be charged for staying.
