For referring professionals

Referring to us is a safe choice for your compliance team.

Discharge planners and case managers carry real legal exposure when they refer. Here is how Mai Heaven is built so that sending us a referral is the low-risk choice — written plainly, not as legal advice.

First, the honest part: Mai Heaven holds no operating license yet and cannot place anyone today. This page explains the compliance standards our referral process is built on — the framework you can count on as homes come online. If you need a placement now, use these resources instead.

No paid referrals — ever

Paying for a healthcare referral is a federal crime under the Anti-Kickback Statute (AKS) and EKRA. Mai Heaven never pays or accepts a fee for a referral. That means referring to us never puts you, or your organization, on the wrong side of a kickback question.

De-identified, HIPAA-minded intake

Our public referral form is de-identified by design — organization, state, and general need only, never a name, date of birth, or diagnosis. Identifying details are exchanged later, through a secure channel and with a signed release. No PHI travels through an open form.

Olmstead-aligned by design

The Supreme Court's Olmstead decision requires people with disabilities to be served in the most integrated setting appropriate. Small, community-based homes are built for exactly that — supporting the community-integration outcomes state agencies are accountable for.

Fair Housing by design

The Fair Housing Act protects small community-based homes for people with disabilities. We build our model around those protections and around residential fit — so a placement is a home on an ordinary street, not a facility.

Honest, verifiable status

We claim no bed we don't have, and publish nothing we can't back up. When a home opens, you can verify everything in person.

A clear compliance trail

Our operating standards — medication, incident reporting, resident rights, grievance path, ADA accommodations — are published on the compliance page, so your team can see how a home runs before anyone is referred.

What this means for your legal and compliance team

The two questions a compliance officer asks about any new placement partner are usually: "Is there a kickback risk?" and "Could PHI leak?" Our answer to both is built into how we operate — no fees in either direction, and an intake that never asks for protected health information in the open.

On top of that, referring to a provider that is explicit about Olmstead integration and Fair Housing gives your agency a defensible, mission-aligned choice when a case is reviewed.

Not legal advice. This page describes how we operate; it is not legal counsel for your organization. For your own AKS/Stark, HIPAA, Olmstead, or Fair Housing questions, consult your compliance officer or healthcare counsel. (Stark Law governs physician self-referral specifically; the rules most relevant to a housing referral are AKS/EKRA and HIPAA.)
